1. Application
These general terms and conditions apply to all purchase and sales agreements entered into by exelle.com | exelle.nl | Studio Jaag and its customers, through our online store.

“Customers” are natural persons who enter into a transaction for a purpose that cannot be attributed to their commercial or self-employed profession.

‘Exelle’ is a trade name used by Studio Jaag.
Wherever Exelle is written, you can read ‘Studio Jaag’

2. Contracting parties, customer service
The exelle brand is provided by Studio Jaag.
The purchase agreement is made with Studio Jaag.

3. The purchase and sale agreement

3.1. You can place an order on the website by clicking the “add to cart” button on the product pages. The desired item will then appear in the online shopping cart. You can then view the shopping cart and make any changes. Once the shopping basket is to your liking, click the “Checkout” button and you will be redirected to a secure environment where you can make payment. After this, the payment is complete.

3.2. Upon processing your order, Exelle will send you an e-mail containing an order confirmation. The purchase and sale agreement takes effect from the time of sending the relevant e-mail.

3.3. Exelle reserves the right to refuse to process a transaction for any reason and/or refuse to provide services to anyone at any time in its sole discretion.

4. Prices, currency and shipping costs

4.1. The prices listed on the website are in Euros and include 21% VAT in accordance with Dutch law. Prices do not include shipping costs.

Exelle reserves the right to change prices at any time.

4.2. Price changes no longer affect the amount due in the case of a purchase and sale agreement already concluded and confirmed by exelle by mail.

4.3. Although all information regarding prices, specifications etcetera is placed on the website with the greatest care, Exelle cannot guarantee its accuracy.
Exelle is under no obligation to deliver orders that are placed based on inaccurate information on the website.

4.3. Shipping costs:

For shipments, we use rates that depend on the country the package needs to be shipped to, and the weight of the package.
For shipments within the Netherlands, Belgium and Germany, with a total value of €200 or more, shipping is free.

Shipping costs are included in the total price indicated on the order list and on the electronic order form. Shipping costs include handling, packaging and postage.

4.4. All import duties and/or local taxes are the responsibility of the customer. These are not included in the price.

4.5. Certain links on the website provide access to sites and resources operated and maintained by third parties. Exelle has no control over these sites and is not liable for their content.

5. Payment

Payment can be made through the payment methods listed on the electronic order form.
The amount due will be debited from your account when your order is accepted by Exelle.

All transactions are conducted through Mollie’s secure payment system. The confidential details of the payment are transmitted through Mollie in encrypted form.
If Mollie refuses to approve a payment, we will delay delivery and contact you. In this case, Exelle is not liable for delay or non-delivery.

Exelle is not liable for misuse of data by third parties.

6. Delivery and Order Collection.

6.1. Exelle makes every effort to ship your order within 2 business days. Exelle is in no way liable if shipment occurs at a later date.
Delivery of ordered products is carried out by selected carriers. Exelle is in no way liable for carrier services.

You are responsible for entering the shipping address correctly.

Exelle ships all packages with track and trace.
You are responsible for accepting the package.

6.2. All Exelle items are insured through Studio Jaag until delivered to your address.

6.3. In case the order was delivered incomplete, you must inform us as soon as possible, no later than 2 days after receipt. We will send the missing article as soon as possible.

6.4. In the event that you receive an item that you did not order, please notify us as soon as possible. We will ask you to return the item free of charge. We will still send you the correct item.

6.5. In the event that the shipment is not delivered to the buyer’s shipping address within 14 days, the buyer is required to notify our customer service department within 14 days via email to info@exelle.com.
Exelle will then have the carrier service investigate the status of the shipment of the order.
Only after Exelle knows the outcome of this investigation we will refund the value of the order.
If the fault for non-arrival of the items lies with Exelle, Exelle will refund the value of your order

We deliver via shipping only. Personal pickup of your order is unfortunately not possible.

7. Compensation in case of claims
You are only entitled to compensation if your claims are legally established, if they are undisputed or have been acknowledged by us in writing.

8. Transfer of ownership
The goods remain the property of Studio Jaag | Exelle until payment is made in full.

9. Damage during shipment
If goods are delivered with visible shipping damage, take pictures immediately and contact Exelle immediately, and no later than 2 days after delivery, by emailing info@exelle.com

10. Right of withdrawal – Right of return
Consumers have a 14-day right of return.

10.1. If for any reason you are not satisfied with a product you have purchased or you have changed your mind about your purchase, you can get a refund if you return the product to us within 14 days. This 14-day period begins on the day you receive the items.
After you notify us in writing by e-mail to info@exelle.com that you wish to return a product, you will receive information from us on how to return it.
To comply with the notice period, timely notification of the return request and timely shipment of the goods is sufficient.
10.2. In the Netherlands, Belgium and Germany, Exelle will bear the costs and risks of return shipping. You are responsible for correctly delivering your package to the parcel service indicated by Exelle.
For all other countries, the customer bears the cost and responsibility for return shipping; please choose a secure, trackable shipping method and return your order to the address below.

10.3. Consequences of a return

After Exelle has received the goods in new condition, you will receive your money back within 5 business days in the same way you paid for the order.
Credit card companies, PayPal and Mollie have their own deadlines for transferring amounts. As a result, it may take longer for the amount to actually be credited to your account. Exelle cannot be held responsible for this.

10.4. If the condition of the goods has deteriorated and in cases where products (for example, due to use) cannot be returned completely or only in a deteriorated condition, you must pay compensation. You are only obliged to pay compensation if the deterioration of the goods obtained is due to the handling of the goods in a way that exceeds the “testing of the principles and functions” of the product. ‘Testing the principles and functions’ means trying and testing the goods in question in the same way as is usual and possible in a store.

10.5. Returns can affect the calculation of shipping costs within the Netherlands, Germany and Belgium.

If, after a return, the total value of your order is still €200 or more, you do not have to pay shipping costs in said countries. If the total value is less than €200 after part of your order has been returned, your right to free shipping will expire. We will then deduct the standard shipping rate from the value of your returned products.

11. Discount Coupon

All discount coupons with an exelle discount code can only be used online at www.exelle.com and www.exelle.nl A discount code cannot be used at any of the physical stores where exelle clothing is on sale.
The discount code can be entered in the shopping cart, then the discount will be applied to the order

12. Personal data and privacy
Exelle respects your privacy. The information provided by you through the website will only be used to process your order and inform you of your order. (Some of) your information is shared with some third parties for this purpose, including for processing your payment and shipping your items.

We will store your information and the details of your order and send you the order dates by email. You can see your previous orders through your personal login.

13. Liability
Any liability of Exelle is limited to the amount of the purchase price.
Exelle shall never be liable for loss of profits or goodwill or any other consequential damages.

14. Copyright
All photos and images on the pages of www.exelle.com and www.exelle.nl are protected by copyright. They may not be used for any purpose without express prior written permission.

15. Applicable law
Dutch law applies to the order and other agreements between Exelle and the buyer, regardless of the country where the product is delivered.
